Terms and Conditions

These Terms and Conditions govern your access to and use of thevineliving.co (the “Website”), including purchases of products and bookings of coaching services offered by The Vine Living Inc. (“The Vine Living,” “we,” “us,” or “our”).

By accessing the Website, placing an order, creating an account, or booking a coaching session, you agree to these Terms and Conditions. If you do not agree with these terms, please do not use the Website or purchase our products or services.

Nothing in these Terms and Conditions limits any rights or remedies available to you under applicable consumer protection laws.

1. Eligibility

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to make a purchase or book a service through the Website.

By placing an order or booking a service, you confirm that:

  • The information you provide is complete and accurate;

  • You are authorized to use the selected payment method; and

  • You have the legal capacity to enter into a binding agreement or have the permission of a parent or legal guardian.

2. Website information

We make reasonable efforts to ensure that the information on the Website is accurate and current. However, product descriptions, prices, images, availability, delivery estimates, recipes, educational content, and other information may occasionally contain errors or omissions.

We reserve the right to correct errors, update information, or make changes to the Website without prior notice. If an error materially affects an order you have already placed, we will contact you and provide an appropriate resolution, which may include the opportunity to confirm or cancel the order.

3. Products and availability

Products offered through the Website may include dried sea moss, sea moss gel, and other food or wellness-related products.

All products are subject to availability. We reserve the right to:

  • Limit the quantity of a product available for purchase;

  • Limit sales to particular people, households, geographic areas, or jurisdictions;

  • Change product ingredients, sizes, packaging, descriptions, or pricing;

  • Discontinue a product; or

  • Refuse or cancel an order where reasonably necessary.

Product photographs are provided for illustrative purposes. Colours, textures, shapes, labels, and packaging may vary slightly from what appears on your screen. Because some products are prepared or packaged in small batches, natural variations may occur.

4. Pricing, taxes and payment

Unless otherwise stated, all prices displayed on the Website are in Canadian dollars.

Applicable taxes, shipping charges, and other fees will be displayed during checkout before you submit your order.

Payments may be processed through Stripe or another payment provider made available at checkout. Your use of a third-party payment service may also be governed by that provider’s terms and privacy practices.

You agree to provide current, complete, and accurate billing and payment information. We are not responsible for delays or declined transactions caused by your financial institution, card issuer, or payment provider.

5. Orders and order acceptance

Submitting an order constitutes an offer to purchase the selected products. An automated order acknowledgement confirms that we have received your order, but it does not necessarily mean that the order has been accepted.

An order is accepted when payment has been authorized and we confirm that the order is being processed or fulfilled.

We may refuse or cancel an order for reasonable reasons, including:

  • Product unavailability;

  • An incorrect price or product description;

  • Suspected fraud or unauthorized payment;

  • An incorrect or undeliverable address;

  • Delivery restrictions;

  • A violation of these Terms and Conditions; or

  • An error affecting the Website, checkout, inventory, or payment system.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

6. Order changes and cancellations

If you need to correct or cancel an order, contact us at order@thevineliving.co as soon as possible.

We will make reasonable efforts to accommodate your request, but we cannot guarantee that an order can be changed or cancelled after preparation, packing, or fulfilment has begun.

7. Shipping and delivery

Products are shipped only to eligible destinations shown during checkout.

Shipping costs and available delivery options are displayed before you complete your purchase. Delivery dates and transit times are estimates and are not guaranteed.

Delivery may be affected by weather, carrier interruptions, holidays, incorrect address information, remote locations, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. Additional charges resulting from an incorrect address, an unclaimed package, or an unsuccessful delivery attempt may be the customer’s responsibility where permitted by law.

8. Perishable products, refunds and replacements

Some products sold by The Vine Living are food products and may be perishable. For health and food-safety reasons, we generally cannot accept returns of food products.

If an order arrives damaged, defective, spoiled, or incorrect, contact order@thevineliving.co within the period specified in our Refund, Replacement & Cancellation Policy. Include your order number and clear photographs of the product, packaging, shipping label, and damage or issue.

Requests are reviewed individually. Where a refund or replacement is approved, the remedy will be provided in accordance with our published policy and applicable law.

Please review our Refund, Replacement & Cancellation Policy before purchasing. Nothing in these Terms and Conditions excludes rights that cannot legally be waived.

9. Product storage and handling

You are responsible for following the preparation, storage, refrigeration, handling, and use instructions included with a product or published on the Website.

Do not consume a product if:

  • Its packaging appears damaged or compromised;

  • It has not been stored according to the provided instructions;

  • It shows signs of spoilage;

  • You are allergic or sensitive to an ingredient; or

  • You otherwise believe it may be unsafe to consume.

Contact us if you have questions about the condition, preparation, or storage of a product.

10. Allergies and dietary requirements

Product descriptions may identify known ingredients, but products may be prepared, packaged, stored, or handled in environments where other foods or allergens are present.

Customers are responsible for reviewing product information and determining whether a product is appropriate for their individual allergies, sensitivities, dietary requirements, or health circumstances.

If you have a serious allergy or dietary concern, contact us before purchasing or consuming a product.

11. Sea moss and wellness information

Information about sea moss, nutrition, recipes, preparation, wellness, and related topics is provided for general educational and informational purposes only.

This information is not medical advice and is not intended to:

  • Diagnose, treat, cure, or prevent any disease or medical condition;

  • Replace advice from a physician, registered dietitian, pharmacist, or other qualified healthcare professional; or

  • Guarantee any particular health or wellness outcome.

Sea moss naturally contains iodine and other naturally occurring nutrients. Their amounts may vary according to species, growing conditions, harvesting, processing, and preparation. Sea moss should be treated as a food rather than as a replacement for a varied and balanced diet.

Speak with an appropriate healthcare professional before using sea moss if you:

  • Are pregnant or breastfeeding;

  • Have a thyroid condition;

  • Are sensitive to iodine;

  • Take prescription medication or supplements;

  • Have allergies or an existing medical condition; or

  • Have been advised to restrict your intake of iodine or another nutrient.

Your decision to purchase, prepare, or consume a product is your responsibility.

12. Recipes and preparation instructions

Recipes, serving suggestions, and preparation instructions are provided as general guidance. Results may vary depending on ingredients, equipment, measurements, storage conditions, and individual preparation methods.

You are responsible for food safety, allergen management, proper storage, appropriate serving sizes, and determining whether a recipe is suitable for you or anyone to whom you serve it.

13. Coaching services

The Vine Living may offer coaching sessions that can be booked and paid for through FluentBooking or another booking platform.

The description, duration, price, availability, and format of each session will be displayed during the booking process.

By booking a coaching session, you agree to:

  • Provide accurate booking and contact information;

  • Attend at the scheduled time;

  • Use the provided meeting link or location information;

  • Participate respectfully; and

  • Provide at least 24 hours’ notice if you need to cancel or reschedule.

14. Coaching cancellations, rescheduling and no-shows

Coaching appointments may be cancelled or rescheduled without penalty by providing at least 24 hours’ notice before the scheduled start time.

Appointments cancelled with less than 24 hours’ notice and missed appointments may be non-refundable and may not qualify for rescheduling, except where required by law or where we agree otherwise.

If you arrive late, the session may still end at its originally scheduled time. If we need to cancel or reschedule a session, we will offer a new appointment time or an appropriate refund.

15. Nature of coaching services

Unless expressly stated otherwise, coaching offered by The Vine Living is educational and supportive in nature.

Coaching is not a substitute for medical care, psychotherapy, mental-health treatment, nutritional counselling, legal advice, financial advice, or another regulated professional service.

No specific outcome is promised or guaranteed. Results depend on numerous factors, including your circumstances, participation, choices, and actions.

You remain responsible for your decisions, wellbeing, and implementation of any information discussed during a session. If you are experiencing a medical or mental-health emergency, contact emergency services or an appropriate qualified professional.

16. Promotions and discount codes

Promotions, coupons, and discount codes may be subject to specific eligibility requirements, expiry dates, product exclusions, geographic restrictions, or minimum purchase amounts.

Unless otherwise stated:

  • Discounts cannot be combined;

  • Discounts have no cash value;

  • Discounts cannot be applied retroactively;

  • A code may be limited to one use per customer or household; and

  • Shipping charges and taxes may be excluded from the discount.

We may refuse or cancel the use of a promotional code where it has expired, was distributed or used improperly, or is affected by a technical or pricing error.

17. Gift cards

If gift cards are offered, they are subject to any terms displayed at the time of purchase and applicable Ontario law.

Gift cards may not be redeemed for cash except where required by law. Lost or stolen gift cards may not be replaceable unless we can verify the original purchase and remaining balance.

18. Customer accounts

You may have the option to create a customer account. You are responsible for:

  • Providing accurate and current information;

  • Keeping your login credentials confidential;

  • Restricting access to your account and devices; and

  • Informing us promptly if you suspect unauthorized use.

We may suspend or terminate an account that is used fraudulently, unlawfully, or in violation of these Terms and Conditions.

19. Reviews, comments and submitted content

If you submit a review, comment, photograph, testimonial, recipe variation, or other content, you confirm that:

  • You created the content or have permission to share it;

  • The content is truthful and based on your genuine experience;

  • It does not infringe another person’s rights;

  • It does not contain unlawful, abusive, defamatory, deceptive, or harmful material; and

  • It does not contain unauthorized advertising, spam, malware, or confidential information.

You grant The Vine Living a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, format, and distribute submitted content in connection with our Website, products, services, and marketing, subject to our Privacy Policy and applicable law.

We may moderate or remove submitted content, but we are not obligated to publish or retain it.

20. Intellectual property

The Website and its original content—including The Vine Living’s branding, logos, photographs, graphics, written content, videos, downloadable guides, page designs, and other materials—are owned by or licensed to The Vine Living and are protected by applicable intellectual property laws.

You may access and use Website content for personal, non-commercial purposes.

Without prior written permission, you may not:

  • Copy or republish substantial Website content;

  • Reproduce our photographs, branding, guides, or videos;

  • Sell, sublicense, or commercially exploit our content;

  • Remove copyright, trademark, or ownership notices; or

  • Represent our content or products as your own.

Nothing in these terms claims ownership over general facts, ideas, cooking methods, or other material that cannot legally be protected.

21. Prohibited uses

You may not use the Website:

  • For an unlawful, fraudulent, or deceptive purpose;

  • To violate another person’s privacy or intellectual property rights;

  • To transmit malware or harmful code;

  • To interfere with Website security or operation;

  • To scrape, harvest, or collect information through unauthorized automated means;

  • To attempt unauthorized access to an account or system;

  • To submit false orders, reviews, or payment information;

  • To impersonate another person; or

  • To engage in abusive, threatening, discriminatory, or harassing conduct.

We may restrict access to the Website or cancel an order where we reasonably believe these restrictions have been violated.

We use third-party providers to operate portions of the Website, process payments, manage bookings, fulfil orders, and provide related services. Your use of certain third-party services may also be subject to their own terms.

We do not guarantee that the Website will always be available, uninterrupted, secure, or free from errors.

We may suspend, restrict, update, or discontinue all or part of the Website for maintenance, security, operational, legal, or business reasons.

We are not responsible for temporary unavailability caused by hosting providers, internet services, third-party platforms, cyber incidents, maintenance, or events beyond our reasonable control.

25. Disclaimer of warranties

To the extent permitted by law, the Website, its content, and its services are provided on an “as available” basis without warranties beyond those expressly provided or required by law.

We do not guarantee:

  • Uninterrupted access to the Website;

  • That all Website information will always be error-free;

  • A particular health, wellness, financial, or personal result;

  • That a product or service will meet every individual preference or expectation; or

  • Outcomes from recipes, educational information, or coaching services.

This section does not exclude statutory warranties or consumer protections that cannot legally be excluded.

26. Limitation of liability

To the maximum extent permitted by applicable law, The Vine Living will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Website, products, content, or services.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms and Conditions excludes or limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Vine Living and its directors, employees, contractors, and representatives from claims, losses, or reasonable expenses arising directly from:

  • Your unlawful use of the Website;

  • Your violation of these Terms and Conditions;

  • Your infringement of another person’s rights; or

  • Content you submit through the Website.

This provision does not apply to losses caused by The Vine Living’s own negligence, misconduct, or violation of applicable law.

28. Events beyond our control

We are not responsible for a failure or delay caused by circumstances beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, labour disputes, government action, public-health emergencies, utility failures, internet outages, cyber incidents, or supply interruptions.

Where such an event affects an order or booking, we will make reasonable efforts to communicate with you and provide an appropriate solution.

29. Governing law

These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any dispute will be subject to the jurisdiction of the courts of Ontario, except where applicable consumer protection law gives you the right to bring a claim in another jurisdiction.

30. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary. The remaining provisions will continue in effect.

31. No waiver

If we do not immediately enforce a provision of these Terms and Conditions, that does not mean we have waived the right to enforce it later.

32. Entire agreement

These Terms and Conditions, together with our Privacy Policy, Shipping & Delivery Policy, Refund, Replacement & Cancellation Policy, and any terms displayed for a specific product, promotion, or service, form the agreement between you and The Vine Living regarding your use of the Website and your purchases or bookings.

If specific terms presented during a purchase or booking conflict with these general Terms and Conditions, the more specific terms will apply to that transaction to the extent of the conflict.

33. Changes to these terms

We may update these Terms and Conditions to reflect changes to our business, Website, products, services, or legal obligations.

The revised version will be posted on this page with an updated “Last updated” date. Changes apply prospectively and do not retroactively alter completed transactions unless required by law or agreed with you.
